Built By Data Privacy Policy

Last Updated: 5 November, 2023

BuiltByData (“BBD”, “our”, “we” or “us”) is committed to respecting and protecting the confidentiality of your personal information.

The purpose of this Privacy Policy (“Policy”) is to explain how and for what purposes BuiltByData collects, uses, discloses, retains, protects or otherwise process your personal information.

1. When does this Privacy Policy apply?

This Policy applies whenever you interact with us, whether by visiting our website at www.BuiltByData.com, our social media accounts and any other online presence we maintain (“Sites”), by subscribing to, using or accessing our products and/or services (“Services”), or otherwise interacting or communicating with us. However, this Policy does not apply to third party websites, applications, or services that you may access by clicking on a link on our Sites or by using our Services. We encourage you to read the privacy statement of every site you visit or interact with.

2. What is personal information?

In this Policy, “personal information” means any information (regardless of its format) that relates to an identifiable individual or that, taken separately or in combination with other data, allows an individual to be identified. This may include, for example, your name, home address, email address, birth date, phone number and information relating to your use of our Services (as the case may be). It may also include other types of more technical information, but only when this information can, directly or indirectly, identify you as an individual. Information that is aggregated and anonymized and cannot be associated with an identifiable individual is not considered to be personal information.

3. What categories of personal information do we collect?

We limit the collection of personal information to what is reasonably required to fulfill the purposes for which it was collected.
We may collect the following personal information about you depending on your interactions with us:

  • o Personal identifiers, such as your name, postal address, phone number, email address, username or signature.

  • o Demographic data, such as date of birth or gender.

  • o Commercial information, such as the description and objectives of your project or your company's situation and needs.

  • o Transactional information, such as whether payments for our service are approved or declined.

  • o Technical information, such as your IP address, browser type, Internet service provider (ISP), referring/exit pages, pages viewed on our Sites.

  • o Employment or recruitment-related information, such as your professional title and occupation, your academic background, your resume or any other information relevant to potential recruitment.

You are not required to provide us with your personal information where it is requested but we may be unable to provide certain products and services or proceed with your business relationship with us if you do not do so.

4. How do we collect personal information?

We collect personal information in a variety of ways, including directly from you, from third parties and through our Sites. Using information we have collected, we may also generate new information about you.

We may collect personal information from the following general sources:

  • o Directly from you, such as when you fill out our contact form on our Sites, contact us by email or telephone with questions or comments, send us a job application, connect with us through social media, or subscribe to our Services.

  • o From third parties, as permitted by law. For instance, we may receive personal information from our service providers that manage customer payments. We may also receive your personal information from other sources with your consent or when authorized by law.

  • o From publicly available sources of information, such as social media sites, blogs and other websites, as permitted by law.

  • o Automatically when you visit our Sites, as further detailed in the “Cookies and Similar Technologies” section below.

5. Cookies and similar technologies

We may collect certain types of information electronically when you interact with our Sites, social media accounts, online advertising or through the use of a third party’s technology, which include cookies, web beacons, single pixel gifs and other similar technologies. This information helps us understand what actions you take on our Sites and mobile applications and allows our website and mobile applications to work correctly.

The technologies we use include:

  • o Cookies, which are small text files that are saved on your computer when you visit a website so that information can be saved between visits, such as your login credentials or language preferences. For example, cookies allow you to log in quickly when you visit our Sites.

  • o Web beacons, and single pixel gifs, which are small image files that have information about you, such as your IP address, that can be downloaded when you visit a website or open an e-mail. This allows us to understand your online behaviour, monitor our email delivery, and provide you with interest-based advertising. These tools also allow our third-party tracking tools to gather information, such as your IP address, and provide this back to us in an anonymized, aggregate form (i.e. in a manner that prevents us from identifying you personally). Aggregate information refers to personal information compiled and expressed in a summary form where no personal identifiers are included.

  • o Other technologies, such as analytics engines and reporting tools, which pull usage data from multiple sources and help manage and collect this data to use for personalization, interest-based advertising, customizing content and other methods to gain insights into our customers’ needs and preferences.

We may use Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses cookies to analyze your use of our Sites, to create reports about visitor activities for us and to provide further services associated with the use of websites and the Internet. Although this information is collected through your Google ad settings, it is not provided to us in a personally-identifiable format.

You may delete or disable certain of these technologies at any time via your browser. However, if you do so, you may not be able to use some of the features on our Sites or mobile applications.

6. Why do we collect, use, and disclose personal information?

We may collect, use and disclose your personal information for the following purposes or otherwise with your consent:

  • o To provide our Services. We use your personal information to assess a request for our Services, to manage any aspect of the Services we offer and to provide you with information about our Services which may be of interest to you, including how to use new features.

  • o To communicate with you, including for marketing purposes. We use your personal information in order to keep you updated on our activities and to provide you with relevant promotional materials and other information on our Services, surveys, contests, promotions and special offers.

  • o To manage our business operations. We may use your personal information for general business purposes such as deploying and managing our information systems, providing you with administrative messages, updates, legal notices, technical notices or security alerts, maintaining our Services, ensuring the security of our systems and Sites, protecting ourselves and third parties from errors and fraud, satisfying audits and other assessments, and meeting our contractual, legal and regulatory obligations.

  • o For research and development purposes. We may use personal information to conduct research in order to help us innovate and improve our Services, and measure the effectiveness of our communication efforts and our Services. When required by law, we will use de-identified information for these purposes.

  • o For other purposes as permitted or required by law. We will not use personal information for any other purpose without your consent, unless permitted or required by law, for instance in order to comply with a legal obligation or as necessary to protect the rights, including proprietary rights, and interests of BuiltByData.

7. How we Share Your Personal Information

We may share your personal information with our service providers, business partners and in the case of the sale or transfer of our business or another transaction. We may also share your personal information with your consent or as permitted or required by applicable law.

We may share your personal information with the following entities:

We only share the personal information required for our business partners to offer the relevant products or provide the relevant programs or services.

  • o Service providers. We may transfer personal information to our service providers, agents, vendors or other organizations that provide services to BuiltByData, so that we can provide our Services to you. These service providers help us operate and manage our technology systems, internal procedures, infrastructure and marketing. They provide services to us such as data hosting, analytics services, accounting, and sending emails and postal mail. We require these service providers to limit their access to and/or use of personal information to what is required to provide their services and adhere to confidentiality as well as security procedures and protections.

  • o Sale or transfer of our business or other transaction. We may decide to sell all or part of our business or assets to a third party, to merge with another entity, or to engage in another form of transaction. If your personal information is required in connection with any such events, we will comply with the legal requirements for the disclosure of personal information and ensure that the handling of your personal information complies with applicable privacy legislation in Canada.

  • o For other purposes permitted or required by law. Applicable laws may permit or require the use, sharing, or disclosure of personal information without consent in specific circumstances, such as investigating illegal activities, or to assist government and law enforcement agencies. If this happens, we will not share more personal information than is reasonably required to fulfill that particular purpose.

  • o With your consent. Other than the purposes listed above, we may, with your implied or express consent, share or disclose your personal information, in accordance with applicable laws.

8. Third Parties

Third parties that you connect with directly through hyperlinks or other information provided on our Website may link and combine information about you with other personal information they may have collected on you, to achieve their own goals and purposes. We do not collect, use or disclose such information, which is subject to the privacy policies of the third party organization. BuiltByData encourages you to review the privacy policies of such organizations.

9. How do we protect your personal information?

BuiltByData takes appropriate organizational, technical and administrative safeguards aimed to prevent any unauthorized access, loss, misuse, modification, disclosure or alteration of personal information in our possession.

10. How long do we keep your personal information?

We store your personal information for as long as is necessary to provide our Services to you, to manage our business operations, and to comply with our legal and regulatory obligations. Once no longer required, your personal information will be securely destroyed or anonymized (so the information no longer identifies you).

11. Cross-border transfers of personal information

While we endeavor to keep your personal information within Canada, we may access, store or process your personal information outside of Canada. Some of our service providers may also access, process or store your personal information outside of Canada. We use reasonable safeguards to ensure that our service providers protect your personal information wherever it is used or stored.

As a result, when your personal information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.

12. What are your rights regarding your personal information?

You have the right to access and rectify the personal information we hold about you. Upon request, we will provide you with access to your personal information within a reasonable timeframe, in compliance with applicable laws. You may make your request by contacting us as set out in the “Contact Us” section. You can inform us of corrections and updates to your personal information through the same procedure. If you request a copy of your personal information, we may request that you pay a nominal fee that will cover the cost of transcription, reproduction or transmission.

The content of our Sites, including this Policy, may be changed at any time. Any changes we make will become effective when we post a modified version of the policy on our website at www.BuiltByData.com. If the changes we make are significant, we will provide a more prominent notice when required by applicable laws.
